Justice Douglas Halfyard and the Judicial Mafia
Justice Douglas Halfyard was appointed to his position on July 1, 1999 by Prime Minister Jean Chretien.
Within a few short weeks, Justice Halfyard proved that he was a member of the judicial mafia when accepted an assignment to the case involving Ms. Gibbs and without allowing Ms. Gibbs to present her arguments and making inappropriate inquiries about her finances dismissed her appeal of the corrupt decision of Master John Horn who had, contrary to law, denied her any share in the net sale proceeds of her property which were in excess of $25,000. John Horn had been appointed to his position by Premier Bill Vander Zalm who was a key figure in the WaterWarCrimes
Background investigations showed that prior to his appointment to judicial office, Douglas Halfyard, had represented Dr. David Kuntz, the brilliant Canadian doctor, who pioneered spinal disk replacement surgery but who was attacked by the British Columbia medical establishment because he took over 50% of the spinal surgery in the province from his clinic in the remote community of Kitimat where, like a modern day Jesus, he helped the lame and crippled walk again - healing people other doctors could not fix. The medical legal establishment attack on Dr. Kuntz was a crime against humanity.
During investigative conversations, Dr. Kuntz expressed his opinion that Douglas Halfyard deliberately lost his case in order to assist the medical legal conspiracy against him. Shortly afterwards, Douglas Halfyard was given a position on the bench. This has come to be a common practice in Canada where lawyers who do favours for the judicial mafia are rewarded with judicial office and it explains how the judicial mafia continues to thrive.
While many of the facts about the Dr. Kuntz case are complex, one can fairly conclude that the class action lawsuit against him was a "fraud" because the case was dropped when the Government of British Columbia agreed to pay a huge sum of money to the group of law firms known as the Canadian Medical Protective Association. The class of litigants who were allegedly injured by Dr. Kuntz experimental surgery suddenly disappeared because they never existed. Douglas Halfyard was a small time player in the Dr. Kuntz scam, but he was duly rewarded with a judicial appointment, and, shortly afterwards, proved to the judicial mafia that he could be relied on when needed by carrying out his orders and depriving Ms. Gibbs of her interest in the proceeds of the sale of her home.
In another interesting decision Douglas Halfyard demonstrated his fondness for criminals as opposed to cleaning up his community from the scourge of cocaine trafficking that has caused so much havoc in resource towns in British Columbia.
According to the Price Rupert Daily News report of February 12, 2004, Justice Halfyard rendered a decision in Prime Rupert that "struck down a section of the Criminal Code of Canada, .... dismissing trafficking charges against XXX, and XXX, and XXX of Prince Rupert as well as XXX of Vancouver".
In the conclusion of a five-and-a-half week trial, Halfyard ruled "none of the evidence presented by the prosecution was admissible as the RCMP had infringed on the defendants' rights against unreasonable search and seizure"
The defendants' legal team, consisting of Martin Griffith-Zahner, Suzette Narbonne and Darrell O'Byrne.
O' Byrne was a law partner with Halfyard when Halfyard was a lawyer.
Was Douglas Halfyard favouring the drug traffickers, or his former law partner, or both?
Douglas Halfyard now works out of the courthouse in Nanaimo, on Vancouver Island, about 700 miles south of Prince Rupert.
Darrell O'Bryne is now a judge of the Provincial Court of British Columbia assigned to the Caribou Northeast Region, about 500 miles east of Prince Rupert, where he is the administrative judge, which means, that Judge O'Byrne decides which judge will hear a particular case.
One thing is certain about both Douglas Halfyard and Darrell O'Byrne, they are no longer working in the Prince Rupert Community where they both worked for many years. A reasonable observers suspects they are no longer welcome there.
